Toby James Nelhams, is one of three people sought by Thai police following the murder of Mr. Kenway, 39 as he sat in his parked Porsche on January 24.
Others wanted by the Thai authorities are South African Abel Bonita, who is believed to have shot Kenway and Miles Turner from the UK, who allegedly drove the motorbike used in the pairs escape. So far, attempts to located the duo have proven to be fruitless.
Nelhams arrived at court donning an orange prison uniform. He hid his face from photographers as he was escorted into the court.
Cambodian police apprehended 44 year old Nelhams but as yet, no charges have been brought against him as far as the murder of Tony Kenway is concerned.
At present he is being held for crossing the Cambodian border illegally from Thailand under articles 29 and 31 of the Law on Immigration, and with breach of trust under articles 391 and 392 of the Criminal Code, according to court spokesperson Ly Sophana.
Mr. Kenway was reportedly murdered over a business disagreement.
